Terms of Use
Last updated 1 October 2026
VIA (Video Intelligence Assistant) is operated by Hungry Passport Media, Inc., 4225 Solano Ave., Suite 631, Napa, CA 94558, USA ("we", "us", "VIA"). These terms are the agreement between you and us for this website and for the VIA private beta. By using either, you accept them. How we handle personal data is in our Privacy Policy. In short: the beta is by invitation, you pay only for credits you choose to buy, your work stays yours, and you are responsible for what you publish.
1. This website
Everything on viaforcreators.com is provided for information. Our guides describe our own experience and are not legal, financial or professional advice. Images and video on the site were produced with VIA and depict invented characters and places.
2. The private beta
VIA is unfinished software offered to a small number of invited creators. Every new studio starts with free welcome credits; anything beyond them is paid for with credits you choose to buy (section 3). Applying does not guarantee a place, and we may decline or end anyone's access at our discretion.
Features, limits and the way things work will change, sometimes without notice, and the service may be unavailable, lose work in progress or produce results that are simply wrong. There is no uptime commitment and no support commitment during the beta. Do not use VIA as the only home of anything you cannot afford to lose: keep your own copy of your scripts and export finished work.
You are never charged for something you did not agree to: nothing is charged until you buy a pack or start a plan yourself, and the studio stops before a task your credits cannot cover. If you are given a beta place, we may ask for feedback; anything you choose to tell us about VIA, we may use freely to improve the product, without obligation to you.
3. Credits and payments
VIA runs on credits. Each picture, clip, voice line and writing step uses credits according to what it actually costs to produce, and the studio shows what you use as you work. A task that fails on the model provider's side uses nothing. The studio stops before a task your remaining credits cannot cover; it never runs you into debt.
Packs add credits once. Credits from a pack do not expire while your account exists. Plans are monthly subscriptions that renew automatically until you cancel; each month's plan credits are added when that month is paid and end with that month, without carrying over. Plan credits are used before pack credits. You can cancel a plan at any time from the Credits page; it then ends at the close of the month already paid. Welcome and gift credits are free, have no cash value, and may be withdrawn if they are abused.
Credits belong to the studio they were bought for and are shared by its members. They have no cash value and cannot be transferred, resold or exchanged for money, except as a refund under this section.
Refunds. If you ask within 14 days of buying a pack, we refund the credits from it that are still unused. Plan payments for a month that has started are not refunded, except where the law requires it. If we end the service, we refund credits you bought and have not used. Write to [email protected]. Refunded credits are removed from your studio.
Prices are in US dollars and are shown before you pay; taxes are added where the law requires. We may change prices: plan changes are emailed at least 14 days before your next renewal, and credits already bought are never affected. Payments are processed by Stripe; we never see or store your full card number.
4. Your content
Your scripts, notes, reference images, characters, locations and anything else you bring remain yours . You grant us only the licence we need to run the service for you: to store your content, to process it, and to send the necessary parts of it to the model providers listed in our Privacy Policy so that your video can be produced. That licence ends when you delete the content or your account, apart from copies in routine backups, which age out.
You promise that you have the rights to everything you upload, and that using it in VIA does not infringe anyone's copyright, trade mark, privacy, publicity or other rights. We do not use your content to train AI models, and we do not show your productions to anyone outside our company except the providers that process them. If we ever want to show your work as an example, we will ask you first.
5. The videos you make
As between you and us, the stills, clips, narration and finished films VIA produces for you are yours to publish, monetize and sell. We claim no ownership of them and take no cut of what they earn.
Two things we cannot promise, and no honest AI tool can. First, outputs are not exclusive: generative models can produce similar results for someone else from a similar request, and we cannot guarantee that a shot is unique. Second, copyright in AI output is limited: under current US law, material generated by AI without meaningful human authorship may not be protected by copyright at all, and how much of a finished video you can register depends on how much of it you creatively shaped. You are responsible for clearing what you publish and for complying with the rules of the platform you publish on.
6. AI-generated content must be disclosed
Everything VIA produces is AI-generated. You must disclose this where the law or the platform requires it. In practice that means: YouTube's disclosure for realistic altered or synthetic content, and, for creators and audiences in the European Union, the transparency obligations of Article 50 of the EU AI Act, which have applied since 2 August 2026.
On our side, we are implementing machine-readable marking of exported video as AI-generated, and we will not strip provenance metadata that a model provider embeds. Until VIA is formally offered in the EU, treat the disclosure obligation for anything you publish as yours.
7. Acceptable use
You may not use VIA to create, or attempt to create:
- A real, identifiable person — their face, body or voice — without their written consent, and never a public figure appearing to say or do something they did not
- Content that deceives about real events, elections, politics, health or safety, or that is presented as genuine footage or a genuine recording
- Sexual content involving minors, or any sexual content depicting a real person without consent
- Harassment, hate, incitement to violence, or content that demeans a person or group
- Anything that infringes someone's copyright or trade mark, including reproducing a protected character, likeness or brand
- Fraud, scams, malware, or content designed to manipulate a platform's systems
- Anything illegal where you are, or where you publish
You also may not resell, sublicense or white-label VIA, attempt to extract the underlying models or prompts, reverse engineer the service, use it to build a competing product, scrape it, or run automated load against it beyond normal use. The usage policies of the model providers apply to your requests as well as ours; breaking them can get a production refused. We may refuse, remove or stop a production that breaks this section, and end access for repeat or serious breaches.
8. Copyright complaints
If you believe something made or hosted with VIA infringes your copyright, write to [email protected] with a description of the work, where the material is, your contact details, and a statement that you believe in good faith the use is unauthorised and that your notice is accurate. We respond to valid notices and we terminate the accounts of repeat infringers.
9. Availability, changes and ending access
We may change, suspend or discontinue any part of VIA, including the beta as a whole. You may stop using it and delete your account at any time. If we end your access other than for a breach of these terms, we will give you a reasonable chance — normally 60 days — to export your work. On termination, sections 3 to 4 and 9 to 12 survive.
10. Disclaimers
VIA is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted operation. AI systems make mistakes: a shot can contradict the script, a face can drift, a fact in your script will not be checked by us. You are the editor. Nothing in these terms excludes liability that cannot lawfully be excluded, and if you are a consumer in the EU or UK your statutory rights are unaffected.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost audience, or lost or corrupted content. Our total liability for any claim relating to VIA is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars ($100).
12. Indemnity
You will defend and indemnify us against claims, losses and reasonable legal costs arising from content you upload or publish, from your breach of these terms, and from your use of videos made with VIA — including claims about rights in what you brought or in what you published.
13. Governing law and venue
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any legal action must be brought in the state or federal courts located in Napa County, California, and each party consents to that jurisdiction. If you are a consumer resident in the EU or UK, this does not deprive you of the protection of the mandatory laws of your own country.
14. Changes to these terms
We may update these terms as the product and the law change, posting the new version here with a new date. Material changes are emailed to beta members at least 14 days before they take effect. Continuing to use VIA after that means you accept them.
